8.1 This website is controlled and operated by us from our offices in England. The formation, existence, construction, performance, validity in all aspects whatsoever of these terms and conditions or of any term of these terms and conditions or any dispute in relation to the materials contained in this website shall be governed by English law and where a dispute arises in Wales, the applicable law will be English law as applied in Wales. The English and Welsh courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions or use of the website.

9. Safe & Secure Shopping
Ordering goods online is considered as safe, if not more so, than ordering goods over the telephone.
It is extremely important that you keep your log-in and other registration details such as your password unknown to anyone but yourself. Always make sure you log out after using our site, especially when using a shared computer.
In line with our security procedures, we will occasionally request proof of identity before we disclose any personal information which we hold about you.
10.1.1. Due to the perishable nature of live plants, often we cannot accept the return of plants. If you are unhappy with, or have changed your mind about your plants order, please contact us to discuss your options before returning your order.
10.2.1. All products that are faulty upon delivery will be entitled to a full refund when we are notified of the fault within 28 days of the fault.
10.2.2. When you notify us of a faulty product, we will arrange a collection of the faulty item and we will cover the cost of this, subject to clause 11.2.3.
10.2.3. Prior to authorising a refund for the faulty item, we will always inspect the item when it has been returned to us. If we find that the item is faulty, we will arrange a full refund or offer free of charge replacement of the faulty item. On the occasion that the item is deemed not faulty by both ourselves and the manufacturer, we will not be able to refund you for the item and will send the item to you and seek to recover the cost of both the initial collection and repeat delivery.
10.2.4. Stock. All plants are offered subject to crop and being unsold upon receipt of order. We reserve the right to substitute without notification, one variety to the nearest, unless otherwise specified by the customer.
10.2.5. All care is taken by the Company to supply stock of the highest quality and true to name, in accordance with the relevant British Standards and handled within C.P.S.E. guidelines. However the Company cannot take responsibility for plant welfare and productiveness once delivery has been accepted unless otherwise agreed.
In accordance with the Information Commissioner’s Office – Privacy and Electronic Communications Regulations, customers will be given the opportunity to opt-out of receiving promotional materials when initially providing their personal information, and during any subsequent electronic communications.
